Question

It is common practice for Qurbani animals to be slaughtered at night even before Fajr time has begun. Is this valid?

Answer

The scholars are unanimous that any animal that is slaughtered during the night preceding Eid al-Adha does not fulfil the Qurbani of a person. The Qurbani is invalid and has to be repeated after Eid Ṣalāh.

It is a sad reality that many Muslims deliberately commit such fraudulent activity. As the slaughter process is regulated in the UK and people are not allowed to slaughter themselves, we strongly recommend to use butchers that are fully certified by the Halal Monitoring Committee (HMC), as the organisation has a robust mechanism in place to ensure Qurbani carcasses are separately identifiable. We understand from previous years that inspectors use a unique colour coding system for animals slaughtered after Eid Ṣalāh to ensure that HMC monitors in the shops can easily distinguish between the Qurbani and non-Qurbani animals. At a national level, this is the only practical system available to ensure the Qurbani supply is genuine. Consumers should therefore visit the HMC website a day before Eid for communication in this regard.

It is also important to realise that if the Qurbani slaughter process begins after Eid Ṣalāh, it is not possible for everyone to receive their Qurbani meat in the morning of Eid al-Adha. If this occurred in the past, slaughter at night is an obvious explanation. Some people will start to receive their Qurbani animals in the morning but for others it will be later in the day. Therefore, HMC should not be blamed for delays, rather be thanked for effective supervision. This does not mean that Qurbani from non-HMC shops is invalid. However, in light of the prevalent fraudulent practices in the market and the inability of most people to visit an abattoir themselves, we strongly recommend you place your order with an HMC certified butcher.

عن البراء رضي الله عنه قال: سمعت النبي صلى الله عليه وسلم يخطب، فقال: إن أول ما نبدأ به من يومنا هذا أن نصلي، ثم نرجع فننحر، فمن فعل هذا فقد أصاب سنتنا، ومن نحر فإنما هو لحم يقدمه لأهله، ليس من النسك في شيء. وعن أنس عن النبي صلى الله عليه وسلم قال: من ذبح قبل الصلاة فليعد. وعن جندب بن سفيان البجلي قال: شهدت النبي صلى الله عليه وسلم يوم النحر فقال: من ذبح قبل أن يصلي فليعد مكانها أخرى، ومن لم يذبح فليذبح، رواها البخاري (٥٥٦٠ إلى ٥٥٦٢). وقال الإمام محمد بن الحسن في الأصل (٥/٤٠٥، طبعة قطر): قلت: أرأيت رجلا يذبح أضحيته قبل أن يصلي الإمام هل يجزيه؟ قال: لا. قلت: لم؟ قال: لأنه بلغنا عن النبي عليه السلام أن رجلا من أصحابه ذبح شاة قبل أن يصلي، فقال: إنما هي شاة لحم. وقال (٥/٤١٢): قلت: أرأيت أهل السواد من كان منهم في غير مدينة ولا مصر من ذبح منهم يوم النحر حين ينشق الفجر هل يجزيهم؟ قال: نعم. قلت: وإن ذبح قبل أن ينشق الفجر؟ قال: لا يجزيه. قلت: ولم؟ قال: لأنه لا يجزيه أن يذبح إلا بعدما ينشق الفجر، لأن ذلك لا يجب عليه حتى ينشق الفجر. وقال في الموطأ (ص ٢١٦): أخبرنا مالك أخبرني يحيى بن سعيد عن عباد بن تميم أن عويمر بن أشقر ذبح أضحيته قبل أن يغدو يوم الأضحى، وأنه ذكر ذلك لرسول الله صلى الله عليه وسلم، فأمره أن يعود بأضحية أخرى. قال محمد: وبهذا نأخذ، إذا كان الرجل في مصر يصلى العيد فيه فذبح قبل أن يصلي الإمام فإنما هي شاة لحم، ولا يجزئ من الأضحية، ومن لم يكن في مصر وكان في بادية أو نحوها من القرى النائية عن المصر فإذا ذبح حين يطلع الفجر وحين تطلع الشمس أجزأه، وهو قول أبي حنيفة رحمه الله، انتهى. وقال ابن المنذر في الإجماع (ص ٢٤): أجمعوا على أن الضحايا لا يجوز ذبحها قبل طلوع الفجر من يوم النحر، انتهى. ونحوه في الإشراف (٣/٤٠٤)۔
