Sleep apnoea mask in Iḥrām
Question
Is it permissible to use a sleep apnoea machine in the state of Iḥrām and is there any penalty?

Answer
It is permissible to use a sleep apnoea machine in the state of Iḥrām if there is a need to do so. However, it will necessitate Ṣadaqah (the amount of Ṣadaqat al-Fiṭr) to a poor person anywhere or fast of one day, as long as it is used for less than 12 hours at any one point. If the mask is used, removed, and re-used several times whilst in the same Iḥrām, there is only one penalty, even if cumulatively the use exceeds 12 hours.
It should be noted that it is not necessary to make intention of entering in the state of iḥrām at home or at the airport. Rather, one can make intention of entering into iḥrām just before passing mīqāt whilst on the plane although the iḥrām clothes can be worn in advance.
قال الحاكم الشهيد في الكافي المطبوع في الأصل (٢/٤٨١): (٢/٤٨٢): وإن غطى المحرم ربع رأسه أو وجهه يوما فعليه دم، وإن كان أقل من ذلك فعليه صدقة. قال (٢/٤٨٤): فإن كان المحرم نائما فغطى رجل رأسه ووجهه بثوب يوما كاملا فعليه دم، ألا ترى أنه لو انقلب في نومه على صيد فقتله كان عليه جزاؤه، انتهى. وقال رحمة الله السندي في اللباب (ص ٤٣٤): ولو غطى جميع رأسه أو وجهه بمخيط أو غيره يوما أو ليلة فعليه دم، وفي الأقل من يوم صدقة، والربع منهما كالكل، انتهى. وراجع الجواب السابق (Wearing a mask in iḥrām)
