Is Taif in Ḥill or outside of Ḥill?

Question

If I travel from the UK to the blessed city of Makkah for ʿUmrah and from there travel to the city of Taif, do I have to enter the state of Iḥrām when returning to the blessed city of Makkah?

Answer

This depends on which part of Taif you visit as the city has expanded and some of its outskirts are within Ḥill (the area between Mīqāt and Ḥaram). The majority of the city including the location of the grave of ʿAbd Allah ibn ʿAbbās (d. 68/687-8) (may Allah be pleased with him) is outside of Ḥill. There are clear signs of the Mīqāt boundary on the main routes in and out of the city.

Therefore, if you are travelling to the outskirts and do not cross the boundary of Ḥill, you are not required to enter the state of Iḥrām on your return. However, if you cross the boundary and visit the main city, you are required to enter the state of Iḥrām on your return.

قال الحاكم الشهيد في الكافي المطبوع في الأصل (٢/٥١٨): كل من أراد مكة لحاجة أو إحرام والوقت بينه وبينها فلا يجاوز الوقت إلا محرما، ومن كان من وراء الوقت إلى مكة فله أن يدخلها لحاجته بغير إحرام، انتهى. وقال (٢/٥١٩): كوفي أراد بستان بني عامر لحاجة ثم بدا له بعد ما قدم البستان أن يحج فأحرم من البستان فلا شيء عليه، وإن أراد أن يدخل مكة بغير إحرام لحاجة فله ذلك، انتهى. وقال محمد في الجامع الصغير (ص ١٤٦): رجل دخل بستان بني عامر لحاجة فله أن يدخل مكة بغير إحرام، انتهى. وقال السمرقندي في تحفة الفقهاء (١/٣٩٤): لا يجوز للآفاقي التجاوز عن هذه المواقيت لدخول مكة لقصد الحج أو للتجارة ونحوها إلا محرما. وقال: وكذلك إن كان من أهل الحرم وأهل الحل من داخل هذه المواقيت إذا خرج إلى الآفاق للتجارة ثم رجع فحكمه حكم أهل الآفاق لا يجوز له مجاوزته إلا محرما إذا قصد مكة إما الحج أو العمرة، انتهى۔
