Entered Ihram after Miqat and performed Umrah

Entered Iḥrām after Mīqāt and performed ʿUmrah

Question

A person travelled from the UK to Makkah Mukarramah and did not enter into Iḥrām at Mīqāt. He went to Tanʿīm and entered into Iḥrām and performed ʿUmrah. I understand that if he returned to Mīqāt before performing ʿUmrah and said the Talbiyah then performed his ʿUmrah, that this would be valid without any penalty. My question is that if after performing ʿUmrah, he returns to Mīqāt and then repeats the ʿUmrah, does this cancel the Dam penalty?

Answer

If a person crosses Mīqāt and enters into Iḥrām thereafter, he is obliged to return to Mīqāt, say the Talbiyah and re-enter into Iḥrām. If he does so before performing ʿUmrah, there is no penalty. If he performs ʿUmrah or even one round of Ṭawāf, then Dam (sacrifice of a goat or equivalent in Ḥaram) is necessary, and returning to Mīqāt will not cancel the Dam penalty.

قال السمرقندي في تحفة الفقهاء (١/٣٩٦): ولو لم يعد إلى الميقات حتى طاف شوطا أو شوطين أو وقف بعرفة في الحج، تأكد عليه الدم حتى لا يسقط عنه وإن عاد إلى الميقات وجدد الميقات والتلبية، انتهى. وقال الحصكفي في الدر المختار (٢/٥٨٠): (فإن عاد) إلى ميقات ما (ثم أحرم أو) عاد إليه حال كونه (محرما لم يشرع في نسك) صفة محرما كطواف ولو شوطا، وإنما قال (ولبى) لان الشرط عند الامام تجديد التلبية عند الميقات بعد العود إليه خلافا لهما (سقط دمه)، انتهى۔
