Saʿy on wheelchair because of baby
Question
A mother did Saʿy for ʿUmrah on a wheelchair because their baby would not sit on her own, so the mother sat on the wheelchair and got pushed by her husband. Is the Saʿy valid and is there any compensation?

Answer
According to the Ḥanafī school, it is Wājib (necessary) to perform Saʿy whilst walking unless one has an excuse. If one performs the full Saʿy on a wheelchair without a valid excuse, then the Saʿy is valid but the penalty of Dam (sacrifice of a goat or equivalent in Ḥaram) is necessary.
In the scenario in question, it was possible for the father to look after the baby whilst the mother did Saʿy, therefore Dam will be necessary on her. Either parent should have delayed their Saʿy.
قال السرخسي في المبسوط (٤/٥١): وكذلك إن فعله راكبا فإن كان لعذر فلا شيء عليه، وإن كان لغير عذر فعليه الدم في الأكثر، والصدقة في الأقل، انتهى. وقال رحمة الله السندي في لباب المناسك (ص ٢٥٣) في واجبات السعي: والمشي فيه، فإن سعى راكبا أو محمولا أو زحفا بغير عذر فعليه دم، ولو بعذر فلا شيء عليه، انتهى. وقال ابن الهمام في فتح القدير (٢/٤٩٥): ومن طاف راكبا أو محمولا أو سعى بين الصفا والمروة كذلك إن كان بعذر جاز ولا شيء عليه، وإن كان بغير عذر فما دام بمكة يعيد، فإن رجع إلى أهله بلا إعادة فعليه دم، لأن المشي واجب عندنا، على هذا نص المشايخ وهو كلام محمد۔
