Gifting wealth to daughter to deprive siblings from inheritance
Question
A person has no spouse or parents, only one daughter and brothers and sisters. He deliberately gifts all the properties and gold to their daughter so that the siblings do not inherit. Will the person be sinful for doing this?

Answer
If a person gifts all or most of his wealth in this manner to deprive the heirs, the gift will be valid, but the person will be sinful. If, however, a person gifts some of his wealth to his daughter in lieu of the daughter’s service for example, then the person will not be sinful. This also cannot be with the intention of depriving the siblings from their inheritance.
قال الحصكفي في الدر المختار (٥/٦٩٦): ولو وهب في صحته كل المال للولد جاز وأثم، انتهى. قال الطحطاوي في حاشية الدر (٣/٤٠٠): وحكاه في حاشية قرة عيون الأخيار تكملة رد المحتار (٢/٣٥٣): قوله (كل المال للولد): أي وقصد حرمان بقية الورثة كما يتفق ذلك في من ترك بنتا وخاف مشاركة العاصب. قوله (جاز) أي صح، لا ينقض. وفي بعض المذاهب: يرد عليه قصده ويجعل متروكه ميراثا لكل الورثة، انتهى۔
