Question

What is the ruling on performing Ṭawāf Ziyārah in menses?

Answer

Ṭawāf in the state of menstruation is prohibited according to all four schools of thought. It is necessary to wait for the menstruation to finish and perform Ṭawāf thereafter. Therefore, if a woman performs Ṭawāf in menses, she will be sinful and must repent to Allah.

If a person has performed Ṭawāf Ziyārah in the state of menstruation, the Ṭawāf must be repeated and there will be no penalty. However, if she does not, according to the Ḥanafī school of thought, her Farḍ (obligation) will be fulfilled and she will be liable to compensate via a Badanah (sacrifice of a large animal e.g. cow, camel in ḥaram). On the other hand, according to the majority of scholars, her Ṭawāf will be invalid and her Hajj incomplete.

It is therefore important to make travel arrangements in a way that the problem does not arise, so that such an important pillar of Islam is successfully completed without this sin and that the Hajj is valid according to all four Imams. It is a matter of severe neglect that many people do not consider this when planning such an important journey and spending large sums of money. Travel operators who are responsible for the pilgrims should ensure that they allow families to return after 20 Dhū al-Ḥijjah or make flexible ticket bookings.

عن عائشة رضي الله عنها أنها قالت: قدمت مكة وأنا حائض، ولم أطف بالبيت ولا بين الصفا والمروة. قالت: فشكوت ذلك إلى رسول الله صلى الله عليه وسلم، قال: افعلي كما يفعل الحاج غير أن لا تطوفي بالبيت حتى تطهري، رواه البخاري (١٦٥٠). قال الترمذي (٩٤٥): والعمل على هذا الحديث عند أهل العلم أن الحائض تقضي المناسك كلها ما خلا الطواف بالبيت، انتهى. وعن ابن عباس أن النبي صلى الله عليه وسلم قال: الحائض والنفساء إذا أتتا على الوقت تغتسلان، وتحرمان وتقضيان المناسك كلها غير الطواف بالبيت، رواه أبو داود (١٧٤٤) وحسنه الترمذي (٩٤٥). وأخرج مالك في الموطأ (۱۲۳٦) ومن طریقه محمد بن الحسن (٤٦٤) عن عبد الله بن عمر قال: المرأة الحائض التي تهل بالحج أو العمرة إنها تهل بحجها أو عمرتها إذا أرادت، ولكن لا تطوف بالبيت ولا بين الصفا والمروة، وهي تشهد المناسك كلها مع الناس غير أنها لا تطوف بالبيت ولا بين الصفا والمروة، ولا تقرب المسجد حتى تطهر. قال محمد: وبھذا نأخذ،  الحائض تقضي المناسك كلها غير أن لا تطوف، ولا تسعى بين الصفا والمروة حتى تطهر، انتهى. وقال الحاكم الشهيد في الكافي المطبوع في الأصل (٢/٣٩٤): وإن لم يرجع فعليه بدنة لطواف الزيارة وشاة لترك طواف الصدر، وعلى الحائض مثل ذلك للزيارة، انتهى۔

وقال ابن المنذر في الإشراف (٣/٣٦٤): في ذلك دليل على أن الطواف بالبيت لا يجزئ إلا لطاهرا، فمن طاف بالبيت جنبا أو على غير وضوء أو كانت المرأة حائضا أو نفساء فهو بمعنى: من لم يطف، وهذا قول عامة أهل العلم، وخالف أهل الرأي ذلك، انتهى. وقال ابن قدامة في المغني (٣/٣٤٣): الطهارة من الحدث والنجاسة والستارة شرائط لصحة الطواف في المشهور عن أحمد، وهو قول مالك والشافعي. وعن أحمد أن الطهارة ليست شرطا، فمتى طاف للزيارة غير متطهر أعاد ما كان بمكة، فإن خرج إلى بلده جبره بدم. وكذلك يخرج في الطهارة من النجس والستارة. وعنه في من طاف للزيارة وهو ناس للطهارة: لا شيء عليه، انتهى۔
