Question

If somebody from the UK is in Makkah al-Mukarramah in Ramadan and also for a few days in Shawwāl and has not performed the Farḍ Hajj, is it necessary on them to perform Hajj in that year?

Answer

If somebody from the UK is in Makkah Mukarramah in Shawwāl and has not performed Hajj, then Ḥajj will be necessary on him that year if he is able to afford Hajj which includes the costs for a modest accommodation and food until the days of Hajj as well as the costs payable to the Saudi authorities. If he is unable to afford this, then Hajj is not necessary on him. If, however, he is able to afford it then he should make every effort to perform Hajj that year. If this is not possible, he should make every effort to perform Hajj as soon as possible and also make a bequest (waṣiyyah) for Hajj to be performed on his behalf from one third of his wealth if this is sufficient to cover the costs, in the event that he passes away before performing Hajj.

It should be noted that the above is when Hajj has not been performed altogether. If Hajj has been performed in a previous year, the ruling does not apply and Hajj will not become obligatory again.

قال الملا علي القاري في شرح اللباب (ص ٦٧): من شرائط الوجوب (الوقت وهو أشهر الحج)، انتهى. وفي اللباب (ص ٥٦): والفقير الآفاقي إذا وصل إلى ميقات فهو كالمكي، انتهى۔

وقال المفتي رشيد أحمد اللديانوي في أحسن الفتاوى (٤/٥٢٩): اگر شوال شروع ہونے سے قبل واپس آگیا تو حج فرض نہیں ہوا، البتہ اگر شوال وہیں شروع ہوگیا اور اس کے پاس حج کے مصارف بھی ہوں تو حج فرض ہوجائیگا، اگر حکومت کی طرف سے حج تک ٹھیرنے کی اجازت نہ ہو تو فرضیت حج میں اختلاف ہے، راجح یہ ہے کہ اس پر حج بدل کرانا فرض ہے، مکہ مکرمہ ہی سے حج کرادے، بعد میں خود حج کی استطاعت ہوگئی تو دوبارہ کرے، كالمقعد والمفلوج والأعمى والمحبوس والخائف من السلطان ۔
