Does sleep of maʿdhūr break ablution?

Question

If a person is maʿdhūr (excused) due to the illness of passing wind, and he sleeps, will this nullify his ablution if he wakes up in the same Ṣalāh time?

Answer

A maʿdḥūr (excused) person is required to perform ablution once for each Ṣalāh time. If the excuse is the passing of wind, and he sleeps during the Ṣalāh time in the state of ablution, his ablution will not be nullified. This is because sleep in itself is not the primary reason for ablution breaking, it is the limbs loosening during sleep and consequently wind passing which is the reason ablution breaks.

وعن علي بن أبي طالب قال قال رسول الله صلى الله عليه وسلم: وكاء السه العينان، فمن نام فليتوضأ، رواه أبو داود (٢٠٣) وابن ماجه (٤٧٧)، وحسنه النووي في شرح المهذب (٢/١٣) وابن الصلاح والمنذري كما في التلخيص الحبير (١/٣٣٣). وقال في الأصل (١/٥٧): أرأيت النوم هل ينقض الوضوء؟ قال: إذا كان قائما أو راكعا أو ساجدا أو قاعدا فلا ينقض وضوءه، وأما إذا نام مضطجعا أو متكئا فإن ذلك ينقض الوضوء، انتهى. وقال ابن الشلبي في حاشية تبيين الحقائق (١/١٠): سئلت عن شخص به انفلات ريح هل ينتقض وضوءه بالنوم. فأجبت بعدم النقض بناء على ما هو الصحيح أن النوم نفسه ليس بناقض، وإنما الناقض ما يخرج، ومن ذهب إلى أن النوم نفسه ناقض لزمه نقض وضوء من به انفلات الريح بالنوم، والله أعلم، انتهى. ونحوه مذكور في فتاوى ابن الشلبي (ص ٤٢). وحكاه ابن عابدين في منحة الخالق (١/٣٩) ورد المحتار (١/١٤١) ووافقه ولم يوافق صاحبَ النهر (١/٥٦) في قوله بأن النوم نفسه ناقض۔
