Question

There are car and real estate companies in India that provide loan with an added price over the normal price of the product. Is this Halal? What about hire purchase?

Answer

There are three scenarios:

First, you take a loan from the company and purchase the car, on the condition that you will repay the loan with a percentage of extra money over a period. This is interest and is prohibited. It is also combining two transactions, the loan and the sale, into one which is also prohibited.

Second, a hire purchase involves hiring a car and paying instalments with the ownership transferring when the last instalment is paid. This is prohibited because it is combining two transactions, the hire (ijārah) and the sale (bayʿ), into one transaction. There are inherent problems with such a transaction as can be understood from the scenario of when a person defaults in his payments.

Third, you purchase the car now and take possession, with the payments fully or partially deferred, to be paid in instalments or a lump sum in the future. This is known as bayʿ muʾajjal and is permissible on the condition that the price and the payment date(s) are fixed in advance. In this scenario, it is permissible for the seller to demand a deposit or a security. It is also permissible to fix a higher price (for example 6 Lakh) than the normal price (for example 5 Lakh), but either price must be fixed at the point of transaction. Therefore, if the seller provides an option to the purchaser with both prices, and the purchaser chooses one option and the seller agrees, this is permissible. However, if this is not fixed at the point of transaction and the contract states, ‘if you pay now, it is 5 Lakh, if you pay in instalments, it is 6 Lakh’, this is prohibited. It therefore follows that once the price is fixed via instalments, a purchaser who makes the payments earlier is not entitled to a reduction in the price. Likewise, although the purchaser can make the payments earlier than stipulated, the seller cannot demand this.

١) و ٢) قال الله تعالى: وأحل الله البيع وحرم الربا. وعن أبي هريرة قال: نهى رسول الله صلى الله عليه وسلم عن بيعتين في بيعة، رواه النسائي (٤٦٣٢) وصححه الترمذي (١٢٣١) ونقل عن بعض أهل العلم قالوا: بيعتين في بيعة أن يقول: أبيعك هذا الثوب بنقد بعشرة وبنسيئة بعشرين، ولا يفارقه على أحد البيعين، فإذا فارقه على أحدهما فلا بأس إذا كانت العقدة على أحد منهما، انتهى. وقال محمد في الأصل (٢/٤٤٠، طبعة قطر): وإذا اشترى الرجل من الرجل بيعا على أن يقرضه قرضا أو يهب له هبة أو على أن يعطيه عطية أو على أن يتصدق عليه بصدقة أو على أن يبيعه كذا وكذا بكذا وكذا من الثمن، فهذا كله فاسد. قال السرخسي (١٣/١٦): لنهي النبي صلى الله عليه وسلم عن بيع وسلف وعن بيعتين في بيعة، انتهى. وقال شيخنا محمد تقي العثماني في فقه البيوع (٢/١١٥٥): البيع الإيجاري (Hire Purchase) حقيقته أن مالك العين يؤجرها إلى آخر بشرط أن المستأجر إذا وفى بجميع أقساط الأجرة في مدة معلومة فإنه يستحق تملكها دون دفع أي ثمن يعتد به، وهو غير جائز شرعا، لكون العقد متردد بين البيع والإجارة، انتهى۔

٣) وعن عائشة قالت: اشترى رسول الله صلى الله عليه وسلم من يهودي طعاما بنسيئة ورهنه درعه، رواه البخاري (٢٠٩٦). وقال القدوري: ويجوز البيع بثمن حال ومؤجل إذا كان الأجل معلوما. قال المرغيناني (٣/٢٤): ولا بد أن يكون الأجل معلوما، لأن الجهالة فيه مانعة من التسليم الواجب بالعقد، فهذا يطالبه به في قريب المدة، وهذا يسلمه في بعيدها، انتهى. وفي البناية (٨/١٦): وفي الكامل: لو قال: بعتكه بألف حالا أو بألفين نسيئة لا يجوز لجهالة الثمن، انتهى. وقال شيخنا محمد تقي العثماني في فقه البيوع (٢/١١٥٧): الأجل في البيع المؤجل حق للمشتري فلا يجوز للبائع مطالبة الثمن قبل حلول الأجل، ولا يجوز له حبس المبيع لاستيفاء الثمن، ولكن يجوز أن يطالب البائع المشتري بتقديم كفالة أو رهن. ويجوز أن يرهن المشتري نفس المبيع بعد قبضه، ولا يجوز أن يرهنه قبل قبضه. ويجوز أن يكون الثمن في البيع المؤجل أكثر من الثمن في البيع الحال، بشرط أن يتفقا على أنه بيع مؤجل وعلى الثمن وعلى موعد تسليم الثمن، ولا يجوز أن يترك العقد مترددا بين كونه حالا أو مؤجلا. فإن لم يتعين الأجل والثمن فسد العقد، انتهى مختصرا۔
