Zakat on money in Nusuk App
Question
Under the new Nusuk Hajj system, users who wish to book a Hajj can top up their eWallets so that once the Hajj packages are released, payments can be made easily from the eWallet. Placing money in the eWallet does not oblige you to purchase a Hajj package, nor does it guarantee that you will succeed in obtaining a Hajj package. If one decides not to proceed, the money can be transferred to the original payment method and there maybe an administration fee for the refund. My question is that if I have transferred money into the eWallet before my Zakat anniversary, and the Zakat anniversary then comes before the Hajj packages are released, do I have to pay Zakat on the money in the eWallet?

Answer
If a Hajj package has not been purchased by the date of your Zakat anniversary and you are not under any contractual obligation to purchase one, then Zakat is necessary on the money in the eWallet.
قال السمرقندي في التحفة (١/٢٧٤): دين يطالب به ويحبس من جهة العباد كديون العباد حالة كانت أو مؤجلة، وهو يمنع، انتهى. وقال الحدادي في الجوهرۃ النیرۃ (١/۱۱٤) وحکاہ ابن عابدین (٢/۲٦۰): وهذا كله إذا كان الدين في ذمته قبل وجوب الزكاة، أما إذا لحقه الدين بعد وجوب الزكاة لم تسقط الزكاة لأنها قد ثبتت في ذمته واستقرت، فلا يسقطها ما لحقه من الدين بعد ثبوتها، انتهى۔
