Written divorce with verbal Inshallah
Question
A person wrote a text message to his wife to scare her, “I divorce you” and immediately said “Inshallah” in the presence of a person to serve as a witness, who he had informed in advance that he was doing this to avoid the Ṭalāq occurring and to scare his wife. Is this valid or has the divorce occurred?

Answer
If the situation is as described and “Inshallah” was said immediately after sending the message, then the divorce has not occurred. However, divorce is not a trivial matter and one should not use divorce or this tactic to scare the wife.
قال ابن نجيم في البحر الرائق (٤/٤٢): إذا كتب الطلاق والاستثناء أو كتب الطلاق واستثنى بلسانه أو طلق بلسانه واستثنى بالكتابة يصح كما في البزازية، انتهى. ونحوه في الدر المختار (٣/٣٧٣) عن البزازية. وفي الفتاوى الهندية (١/٣٧٨): وإذا كتب الطلاق واستثنى بلسانه أو طلق بلسانه واستثنى بالكتابة هل يصح، لا رواية لهذه المسألة، وينبغي أن يصح، كذا في الظهيرية، انتهى. ونقله ابن عابدين في رد المحتار (٣/٢٤٧) تبعا للطحطاوي (٢/١١١) عن الهندية. وقال السمرقندي في تحفة الفقهاء (٢/١٩٣): ولو حرك لسانه بالاستثناء وأتى بحروفه على الوجه لكنه لم يسمع، يكون استثناء، لأن هذا كلام، وليس الشرط هو السماع، انتهى. وهذا الحكم الذي ذكره السمرقندي مختلف فيه، وليس هو المقصود هنا، إنما المقصود جملته الأخيرة۔
