When seeking bride’s consent, do witnesses have to be Maḥram?
Question
Please provide the Islamic ruling with regards to the witnesses when seeking permission from the girl in marriage, do they have to be Maḥrams?

Answer
The requirement for witnesses is at the time of the actual Nikāḥ (marriage) when the offer and acceptance occur between the man and the woman or their representative(s). Therefore, when a wakil (representative) seeks the woman’s consent prior to this, there is no requirement for any witnesses to be present. However, it is desirable to have witnesses present to avoid any potential disputes and they are not required to be Maḥram. If they are non-Maḥram, the Islamic rulings pertaining to Ḥijāb and modesty must be followed.
قال الكاساني في البدائع (٢/٢٥٦) وأقره في الفتاوى الهندية (١/٢٦٩) واللفظ له: ووقت حضور الشهود وقت الإيجاب والقبول لا وقت الإجازة حتى لو كان العقد موقوفا على الإجازة ولم يحضرا عند العقد لم يجز، هكذا في البدائع، انتهى. وقال ابن عابدين في رد المحتار (٣/٢١): قوله (وشرط حضور شاهدين) أي يشهدان على العقد. أما الشهادة على التوكيل بالنكاح فليست بشرط لصحته كما قدمناه عن البحر، وإنما فائدتها الإثبات عند جحود التوكيل. وفي البحر قيدنا الإشهاد بأنه خاص بالنكاح لقول الإسبيجابي: وأما سائر العقود فتنفذ بغير شهود ولكن الإشهاد عليه مستحب للآية. اهـ، وفي الواقعات أنه واجب في المداينات، انتهى. وقال ضمن مسئلة التزوج بالكتاب (٣/٢٣): لا يشترط الإشهاد على التوكيل، انتهى. وراجع البحر الرائق (٣/٨٨ و ٩٦). واشترطها الحسن بن صالح عند التوكيل بالنكاح، ورده ابن قدامة في المغني (٧/١٩)۔
