Open Heart Surgery with pig origin valves
Question
A friend is expected to have an open-heart surgery to replace the heart valves. The replacement valves as grafts are of pig origin, as these are the most compatible with humans. Is this permissible?

Answer
It will be permissible to use the replacement valves in question if a Muslim doctor confirms that it is necessary and that there is no alternative. If, however, there is an alternative that is Ḥalāl or less severe, then it will not be permissible to use the replacement valves of pig origin. We understand from medical practitioners that there are Bovine (cow) valves available for certain valves in certain situations and there are also metal options in certain circumstances. These should be researched and checked with medical professionals.
قال القدوري في مختصره (ص ١٣): وكل إهاب دبغ فقد طهر، وجازت الصلاة فيه والوضوء منه إلا جلد الخنزير والآدمي. وقال (ص ٢٠٧): وإذا ذبح ما لا يؤكل لحمه، طهر لحمه وجلده إلا الآدمي والخنزير، فإن الذكاة لا تعمل فيهما، انتهى. وقال الحصكفي في الدر المختار (١/٢٠٤): (خلا) جلد (خنزير) فلا يطهر، انتهى۔
وقال فخر الإسلام البزدوي: فعل الاستشفاء بالحرام إنما لا يجوز إذا لم يعلم أن فيه شفاء، أما إذا علم أن فيه شفاء وليس له دواء آخر غيره يجوز الاستشفاء به، كذا في البناية (١٢/٢٧١). وقال الزيلعي في تبيين الحقائق (٦/٣٣): قال في النهاية: يجوز التداوي بالمحرم كالخمر والبول إذا أخبره طبيب مسلم أن فيه شفاء، ولم يجد غيره من المباح ما يقوم مقامه. وقال (٦/٤٩): وذكر في النهاية أن الاستشفاء بالحرام جائز إذا علم أن فيه شفاء، وليس له دواء آخر غيره وعزاه إلى الذخيرة، انتهى. وقال البابرتي في العناية (١٠/٦٧): فإن علم أن فيه شفاء وليس له دواء آخر غيره يجوز له الاستشفاء به. وقال الحصكفي في الدر المختار (١/٢١٠): وقيل: يرخص إذا علم فيه الشفاء ولم يعلم دواء آخر كما رخص الخمر للعطشان وعليه الفتوى، انتهى. وراجع رد المحتار (٥/٢٢٨)۔
