Agreed to lease without looking
Question
I placed an advert online to lease my apartment. A person contacted me that he wanted to lease the apartment and transferred the deposit and the rental for the first month. Thereafter, when he entered the apartment for the first time the following day, he changed his mind and wants to cancel the lease. From an Islamic perspective, am I obliged to cancel the lease and refund all the money?

Answer
If he did not see the apartment before entering into the lease arrangement, he has the right to cancel when he sees the apartment and you are obliged to return the money to him.
قال في الأصل (٣/٤٩٠، طبعة قطر): رجل تكارى من رجل دارا ببغداد بمائة درهم كل سنة، وأسلفه أجرها، فلما قدم الكوفة قال: لا أرضى بها، وقد كان رأى الدار قبل ذلك أو لم يرها، هل له أن يردها ويرجع بدراهمه على رب الدار؟ قال: هو بالخيار إذا رآها إن لم يكن رآها قبل ذلك ويترك الإجارة ويأخذ دراهمه، وإن كان رآها قبل ذلك فلا خيار له في ذلك إلا أن يكون انهدم من الدار شيء يضر بالسكنى في قول أبي حنيفة وأبي يوسف ومحمد، انتهى۔
