Adoption and inheritance
Question
In some countries, adopted children are legally entitled to inheritance similar to biological children. What is your advice regarding this?

Answer
In Islam, an adopted child is not regarded as the adopter’s child, and therefore the child will not inherit from the adopter. It is therefore necessary for an adopter to write a will affirming that the adopted child should not inherit from him. It is however permissible for an adopter to bequeath up to one third of the wealth for the adopted child.
قال الله تعالی: وما جعل أدعیاءكم أبناءكم ، ذلكم قولكم بأفواهكم ، والله یقول الحق وهو یهدي السبیل ، ادعوهم لآبائهم هو أقسط عند الله ، فإن لم تعلموا آبائهم فإخوانكم في الدین وموالیكم ، وقال النبي صلی الله علیه وسلم: الثلث والثلث كثیر أو كبیر ، رواه البخاري (۲۷٤٤) ، وقال محمد بن الحسن في الموطأ (۷۳٦): لا یجوز لأحد وصیة بأكثر من الثلث إلا أن یجیز الورثة ، وهو قول أبي حنیفة والعامة من فقهائنا رحمهم الله تعالی ، وقال القدوري (صـ ۲٤۲): ولا تجوز الوصية لوارث إلا أن يجيزها الورثة ولا يجوز الوصية بما زاد على الثلث۔
