Question

We are travelling from the UK to Makkah for three days, then Madīnah for three days, and then back to Makkah. During our first three days in Makkah, my daughter will be unable to perform ʿUmrah due to menstruation. What should she do in this scenario? Her menses is expected to finish whilst we are in Madīnah.

Answer

If a person is crossing Mīqāt with the intention of travelling to Ḥaram (Makkah al-Mukarramah), it is necessary to enter into the state of Iḥrām. If one crosses the Mīqāt without entering the state of Iḥrām, then Dam (sacrifice of a goat or equivalent animal in Ḥaram) becomes necessary. This Dam is cancelled if one returns to any Mīqāt and enters into the state of Iḥrām.

Based on this, your daughter should enter into the state of Iḥrām when initially travelling to Makkah al-Mukarramah, remain in the state of Iḥrām throughout the stay in Makkah and Madīnah and perform ʿUmrah on the second visit to Makkah after her menses finishes. All the rules pertaining to Iḥrām will apply throughout. When returning from Madīnah Munawwarah, she will not enter into a new Iḥrām because she will already be in the state of Iḥrām.

If, however, your daughter does not enter into the state of Iḥrām before the first visit to Makkah al-Mukarramah, she will proceed to Madīnah Munawwarah, and thereafter enter into the state of Iḥrām and proceed to Makkah al-Mukarramah and perform ʿUmrah in the state of purity. There will be no penalty. If, however, she does not return to Makkah al-Mukarramah to perform ʿUmrah, the Dam penalty will apply.

قال الحاكم الشهيد في الكافي المطبوع في الأصل (٢/٥١٨): كل من أراد مكة لحاجة أو إحرام والوقت بينه وبينها فلا يجاوز الوقت إلا محرما. وقال (٢/٥٢٢): ومن جاوز وقته غير محرم ثم أتى وقتا آخر فأحرم منه أجزأه، ولو كان أحرم من وقته كان أحب إلي. وقال (٢/٥٢٤): وإذا دخل الرجل مكة بغير إحرام فجعلت عليه حجة أو عمرة فأهل بها بعد سنة من وقت غير وقته الأول هو أقرب منه، قال: يجزيه وليس عليه شيء، انتهى. وقال السمرقندي في تحفة الفقهاء (١/٣٩٥): ثم الآفاقي إذا جاوز الميقات بغير إحرام وهو يريد الحج أو العمرة ثم عاد إلى الميقات قبل أن يحرم فأحرم منه وجاوزه محرما، فإنه لا يجب عليه الدم لأنه قضى حقه بالإحرام، انتهى. وقال داملا أخون جان: أثم بالمجاوزة، كذا في حاشية شرح لباب المناسك (ص ١١٩)۔
