Can ‘Too Good To Go’ app be used?
Question
Is it permissible to purchase food from the Too Good To Go app? The app allows you to purchase a food bag from an outlet of your choice at a reduced cost, however the contents of the bag are not known. Customers do not know what is exactly in the bag and only find out once purchased, as different items will be unsold every day. Is this classed as majhūl? The app specifies the approximate original value of the items (for example £12) and the discounted price of the bag (for example £4).

Answer
It is permissible to purchase food bags from the Too Good to Go app as long as you are certain that the items in the bag will be Ḥalāl, even if the specific contents are not known. Therefore, if a store or restaurant sells both Ḥalāl and Ḥarām and the bags could contain Ḥarām items, then it will not be permissible to purchase food bags from such a supplier. However, if a store or restaurant only provides Ḥalāl items in the food bags, then it is permissible to purchase the food bags. Not knowing the specific items in the bag is tolerable because it would not lead to disputes as long as they are Ḥalāl, because the price is reduced, and this benefits the purchaser and seller and also reduces food waste.
قال الولوالجي في فتاويه (٣/١٤٠) ولخصه الزين بن نجيم في البحر (٥/٢٩٦) وتبعه أخوه عمر في النهر (٣/٢٤٢) وابن عابدين في رد المحتار(٤/٥٢٩) في المسائل الخمس، وهي بيع جميع ما في هذه القرية أو هذه الدار أو هذا البيت أو هذا الصندوق أو الجوالق: فإن علم المشتري ما فيها جاز، وإلا ففي الأولين لا يجوز لفحش الجهالة، وفي الثلاثة الأخيرة يجوز لأن الجهالة يسيرة، انتهى ملخصا من البحر. وقال قاضي خان في فتاويه (٢/٢٢): ولو قال بعت منك جميع مالي في هذا البيت بكذا جاز وإن لم يعلم به المشتري، لأن الجهالة في البيت يسيرة وفيما تقدم من الدار وغيرها كثيرة، وإذا جاز في البيت يجوز في الصندوق والجوالق، انتهى. ونحوه في فتح القدير (٦/٢٦٧). وحكى ابن نجيم في البحر (٥/٢٩٥) كلام قاضي خان ثم قال: وبه ظهر أن الجهالة اليسيرة في المبيع لا تمنع، انتهى۔
وقال شيخنا محمد تقي العثماني في تكملة فتح الملهم (١/٢٠٩): ويخرج على هذا كثير من المسائل في عصرنا، فقد جرت العادة في بعض الفنادق الكبيرة أنهم يضعون أنواعا من الأطعمة في قدور كبيرة، ويخيرون المشتري في أكل ما شاء بقدر ما شاء، ويأخذون ثمنا واحدا معينا من كل أحد، فالقياس أن لا يجوز البيع لجهالة الأطعمة المبيعة وقدرها، ولكنه يجوز، لأن الجهالة يسيرة غير مفضية إلى النزاع، وقد جرى بها العرف والتعامل، انتهى. وراجع فقه البيوع (١/٣٧٢ و ٣٨٨) له۔
