Ṣadaqah al-Fiṭr for newborn baby
Question
If a child is born on 29 Ramaḍān, is it necessary for Ṣadaqah al-Fiṭr to be given on the child’s behalf?
بسم الله الرحمن الرحیم
Answer
It is necessary on a person to give Ṣadaqah al-Fiṭr on behalf of all the non-bāligh (non-mature) children including any newborn children who are alive at the time of Ṣubḥ Ṣādiq (true dawn) on the day of Eid al-Fiṭr. Likewise, if a person accepts Islam before Ṣubḥ Ṣādiq on the day of Eid al-Fiṭr, it is necessary for him to give Ṣadaqah al-Fiṭr. This is subject to fulfilling the other criteria of Ṣadaqah al-Fiṭr becoming obligatory.
قال السرخسي في المبسوط (۳: ۱۰۸): كل من أسلم من الكفار لیلة الفطر فعلیه صدقة الفطر عندنا، لأن وقت الوجوب جاء وهو مسلم، وكل من یولد لیلة الفطر فعلیه صدقة الفطر عندنا، انتهی، وراجع تحفة الفقهاء (صـ ۳۳۹) وبدائع الصنائع (۲: ۷٤) وتبیین الحقائق (۱: ۳۱۰)، وفي الأصل (۲: ۲٥۰): قلت: فإن كان ولده صغیرا هل یجب علیه أن یؤدي عنه، قال: نعم، انتهی، وفي الأصل (۲: ۲٥۹): قلت: أرأیت رجلا أسلم بعد طلوع الفجر یوم الفطر أیجب علیه صدقة الفطر، قال: لا، قلت: فإن أسلم لیلة الفطر هل علیه صدقة الفطر، قال: نعم، انتهی۔
