Question

Is the Lifetime ISA compliant with Shariah?

Answer

The Lifetime ISA is not compliant with Shariah. The government adding 25% bonus to the savings is akin to interest (shubhat al-ribā) as it is a risk-free gain on the saving and it is an intrinsic component of the ISA. The bonus is also proportionate to the savings which affirms that it is usurious in nature.

In addition to this, if a person withdraws money before reaching the age of 60 and for other than purchasing a first home, there is a 25% withdrawing charge, which results in receiving back less than the original saving amount. This is also problematic.  

عن عمرو بن شعيب عن أبيه عن جده أن رسول الله صلى الله عليه وسلم نهى عن سلف وبيع، وشرطين في بيع، وربح ما لم يضمن، رواه النسائي (٤٦٢٩) ومحمد في الأصل (٣/٢٣، طبعة قطر) وغيرهما، وصححه الترمذي (١٢٣٤) والحاكم (٢١٨٥) وأقره الذهبي، وراجع نصب الراية (٤/١٨)۔

وقال محمد في الأصل (٣/٢٢): وحدثنا أبو يوسف عن أبي حنيفة عن حماد عن إبراهيم أنه كان يكره كل قرض جر منفعة. وروى محمد في كتاب الآثار (٢/٦٤٧) وعبد الرزاق (١٤٦٥٩) عن إبراهيم قال: كل قرض جر منفعة فلا خير فيه. قال محمد: وبه نأخذ، وهو قول أبي حنيفة رحمه الله تعالى، انتهى. وروى ابن أبي شيبة (٢٠٦٩٠) عن إبراهيم قال: كل قرض جر منفعة فهو ربا. وروى (٢٠٦٩٢) عن ابن سيرين قال: أقرض رجل رجلا خمسمائة درهم واشترط عليه ظهر فرسه، فقال ابن مسعود: ما أصاب من ظهر فرسه فهو ربا. وعن فضالة بن عبيد صاحب النبي صلى الله عليه وسلم أنه قال: كل قرض جر منفعة فهو وجه من وجوه الربا، رواه البيهقي (١٠٩٣٣)، وهو موقوف في حكم المرفوع۔

وقال في الأصل (٣/٢٥): ولا بأس بأن يقبل الرجل هدية من رجل له عليه دين قرض أو غيره ما لم يشرط، انتهى. وقال السرخسي في المبسوط (١٤/٣٥): إن المنفعة إذا كانت مشروطة في الإقراض فهو قرض جر منفعة، وإن لم تكن مشروطة فلا بأس به، انتهى. وقال الكاساني في البدائع (٧/٣٩٥): وأما الذي يرجع إلى نفس القرض فهو أن لا يكون فيه جر منفعة، فإن كان لم يجز، نحو ما إذا أقرضه دراهم غلة على أن يرد عليه صحاحا، أو أقرضه وشرط شرطا له فيه منفعة، لما روي عن رسول الله صلى الله عليه وسلم أنه نهى عن قرض جر نفعا، ولأن الزيادة المشروطة تشبه الربا، لأنها فضل لا يقابله عوض، والتحرز عن حقيقة الربا وعن شبهة الربا واجب. وقال (٧/٣٩٦): أما حكم القرض فهو ثبوت الملك للمستقرض في المقرض للحال، وثبوت مثله في ذمة المستقرض للمقرض للحال، انتهى۔

وقال ابن مازة في المحيط البرهاني (٥/٣٦٦ و ٧/١٢٧): وأما هدية المستقرض، إن كانت الهدية مشروطة في الاستقراض فهو حرام، ولا ينبغي للمقرض أن يقبل، انتهى. وقال ابن الهمام في فتح القدير (٧/٢٧٢) وحكاه ابن نجيم (٦/٣٠٥) وابن عابدين (٥/٣٧٤): ويجب أن يكون هدية المستقرض للمقرض كالهدية للقاضي إن كان المستقرض له عادة قبل استقراضه فأهدى إلى المقرض، فللمقرض أن يقبل منه قدر ما كان يهديه بلا زيادة، انتهى۔

“You can use a Lifetime ISA (Individual Savings Account) to buy your first home or save for later life. You must be 18 or over but under 40 to open a Lifetime ISA. You can put in up to £4,000 each year, until you’re 50. The government will add a 25% bonus to your savings, up to a maximum of £1,000 per year.

You can withdraw money from your ISA if you’re:

  • buying your first home
  • aged 60 or over
  • terminally ill, with less than 12 months to live

You’ll pay a 25% charge if you withdraw cash or assets for any other reason. The withdrawal charge aims to recover the government bonus received and apply an extra charge to the original savings. “If I withdraw from my Lifetime ISA and pay the 25% charge, will this apply to the amount I’m withdrawing or my full balance? The 25% government withdrawal charge is applied to the amount you withdraw. As well as recovering the 25% government bonus, you’ll also lose some of your own savings and will receive back less than you invested. This is demonstrated in the example below. This example doesn’t include any interest earned.
