Waqf conditional on receiving rent until demise
Question
If someone wants to make a property of theirs as Waqf on the condition that they receive the rent until their demise, is this allowed?

Answer
It is permissible for a person to make a property Waqf with the condition that the rent will benefit them until their demise and thereafter the proceeds will go to the charitable cause the property is endowed to. It should be noted that once a property is made Waqf, this is not reversible. Accordingly, Waqf property is not subject to the laws of inheritance and Waṣiyyah. This is different to making a bequest (Waṣiyyah) which is restricted to one third, and is changeable until one’s demise, because the ownership is retained by the person. Once a Waqf is made, the ownership ceases, and the person only reserves the right to benefit from it if this is what he has stipulated.

قال محمد في كتاب الأصل (١٢/٩٦): أخبرنا صخر بن جويرية، عن نافع مولى عبد الله بن عمر، أن عمر بن الخطاب كانت له أرض تدعى ثمغ، قال: وكان نخلا نفيسا. فقال عمر رضي الله عنه لرسول الله صلى الله عليه وسلم: إني قد استفدت مالا وهو عندي نفيس، أفأتصدق به؟ فقال له رسول الله صلى الله عليه وسلم: تصدق بأصله لا يباع ولا يوهب ولا يورث ولكن لتنفق ثمرته. قال: فتصدق عمر به، وتصدق بخيبر في سبيل الله وفي الرقاب والضيف والمساكين وابن السبيل ولذي القربى. ولا جناح على من وليه أن يأكل منه بالمعروف أو يؤكل صديقا غيره غير متمول فيه. قال محمد: وبهذا نأخذ، إن تصدق بذلك في حياته وصحته كان ذلك من جميع ماله، وإذا تصدق في مرضه كان ذلك من ثلثه. وأما أبو حنيفة فكان لا يجيز ذلك إلا أن يجعله وصية بعد موته، انتهى. والفتوى على قول الصاحبين كما هو معروف، وراجع نماذج ألفاظ الوقف المطلق والمقيد في كلام محمد في الأصل (١٢/٦٦، ٧٣، ٧٨)۔
