Inheritance Calculation Error
Question
My father passed away approximately twenty years ago. He left behind his mother, his wife, two daughters and a son. The Islamic Shariah Council of Leyton advised at the time in writing (refer to the attached) that the inheritance will be distributed as follows:
“Total shares = 46.
Wife = One eight = 6 shares.
Mother = One sixth = 8 shares.
Son from the remainder = 16 shares.
2 daughters = each 8 shares.”
Is this correct?
بسم الله الرحمن الرحیم
Answer
This is not correct. The inheritance shares in this scenario are as follows:
- Total shares = 96
- Wife – 12/96th (1/8th)
- Mother – 16/96th (1/6th)
- Son – 34/96th
- Each daughter – 17/96th
