Travelling from Makkah to Madīnah without performing ʿUmrah

Question

If a woman in menses enters the state of Iḥrām at Mīqāt and travels to Makkah for ʿUmrah, and thereafter decides to travel to Madīnah and remain in her Iḥrām and perform her ʿUmrah on return, because she is still in her menses, is this permitted?

Answer

A woman in the state of Iḥrām who is in Makkah should wait for her menses to end and perform her ʿUmrah. However, if it is not possible for her to remain in the blessed city of Makkah for practical reasons or otherwise, it is permissible for her to travel to the blessed city of Madīnah and perform ʿUmrah on return on the condition that she remains in her Iḥrām throughout this period.

قال القدوري في المختصر (ص ٧٦): العمرة لا تفوت وهي جائزة في جميع السنة إلا خمسة أيام يكره فعلها فيها: يوم عرفة ويوم النحر وأيام التشريق، انتهى. ونحوه في المبسوط (٤/١٧٨) وغيره. وقال أبو منصور الكرماني الحنفي في المسالك في المناسك (١/٦٢٠) وحكاه عنه أبو البقاء المكي الحنفي في البحر العميق في مناسك المعتمر والحاج إلى البيت العتيق (٤/٢٠٥٧): ولا يجب لتأخير طواف العمرة ولا لتأخير سعيها شيء، لأن وقت العمرة واسع في جميع السنة، انتهى۔

وقال الإمام الشافعي في الأم (٢/١٥٧): ومن أهل بعمرة في سنة فأقام بمكة أو في بلده أو في طريق سنة أو سنتين كان على إحرامه حتى يطوف بالبيت وكانت هذه العمرة مجزئة عنه لأن وقت العمرة في جميع السنة، انتهى۔
